How It Works

The Registration Process

From clearance search to registration certificate — here is what to expect.

1

Clearance Search

We search existing trademarks in your class to check whether your mark is available before you file.

2

File the Application

We prepare and file Form TM-A with the Trademark Registry, with the correct class and specification of goods or services.

3

Examination

The Registry examines the application and may raise an examination report, which we respond to on your behalf.

4

Journal Publication

An accepted mark is published in the Trademark Journal, opening a window for third parties to file an opposition.

5

Registration Certificate

If unopposed, the mark proceeds to registration and a certificate is issued in your name.

6

Renewal

We track renewal timelines so your registration stays active and enforceable long-term.

Frequently Asked Questions

How much does trademark registration cost in Delhi?

Government filing fees under the Trade Marks Rules, 2017 are Rs 4,500 per class for individuals, startups and MSMEs filing online (Rs 5,000 for paper filing), and Rs 9,000 per class for companies and LLPs. This is separate from professional fees. Renewal after 10 years costs Rs 9,000 per class, and restoring a removed mark costs Rs 18,000 per class.

How long does trademark registration take in India?

A straightforward, unopposed application typically takes 12 to 18 months from filing to registration certificate, covering examination, journal publication and the opposition window. Expedited examination under Rule 34 (Form TM-M) can shorten the initial review, though publication and opposition timelines still apply.

What is expedited trademark registration and what does it cost?

Expedited examination lets your application jump the queue for the initial review stage. The government fee is Rs 20,000 per class for individuals, startups and small enterprises, and Rs 40,000 per class for companies and LLPs, filed on Form TM-M under Rule 34 of the Trade Marks Rules, 2017.

I received a trademark examination report or objection — what should I do?

You have one month from the date of the examination report to file a response, supported by evidence of distinctiveness or prior use where relevant. Missing this deadline can result in the application being treated as abandoned, so early legal review of the objection grounds is important.

What is the difference between trademark registration and trademark opposition/litigation?

Registration is the process of filing and securing a new trademark with the Registry. Opposition and litigation arise later, if a third party challenges your mark or if you need to enforce it against infringement. Apex Legis handles registration through this service and IP disputes through our separate IP Disputes & Enforcement practice.

Can I register a trademark for a well-known or already-popular brand?

A mark that has acquired significant reputation and recognition in India may qualify for recognition as a 'well-known trademark' under Section 11(6)-(9) of the Trade Marks Act, giving it broader protection across classes. This is a separate, more evidence-intensive process from ordinary registration.
