You must file a counter-statement within two months of receiving the notice of opposition, or the application is deemed abandoned. The matter then proceeds through evidence, a hearing, and a decision by the Registrar. We assess the opposing party's grounds early so the counter-statement is built on the strongest available defence.
Someone is using a mark similar to mine — what are my options?
Options range from a cease-and-desist notice, to filing a rectification or cancellation petition against a conflicting registration, to a full infringement or passing-off suit seeking an injunction and damages before the Delhi High Court or District Courts, depending on the strength of your rights and the scale of the infringement.
What is trademark rectification and when is it used?
Rectification is a petition to remove or correct an existing trademark registration — for instance where it was wrongly registered, has become generic, or was not renewed correctly. It is distinct from opposition, which challenges a pending application before it registers.
